L Visas: Intra-company Transferees

The L visa classification is applicable to specialized employees of multinational businesses with offices in many countries who are frequently assigned for tours of duty abroad.  An L visa applicant is not required to demonstrate a residence abroad, and like an H1B, is exempt from the intending immigrant refusal grounds covered in INA 214(b).  The L category covers only company managers and executives and employees with “specialized knowledge”. An applicant for an L visa must present:

  • An original, approved I-797 form. 
  • Evidence that he or she has been employed overseas by the transferring organization for at least one year within the past three years.
  • Evidence that the position to be filled by the L visa applicant in the U.S. is managerial, or executive, or involves specialized knowledge. 

Evidence may include, but is not limited to:        

    • Employment contract     
    • Salary information
    • Prior assignments abroad       
    • Educational credentials
