H-1B Visas: Temporary Work Visas

In addition to the required passport, fee receipt, application form, and color photograph against white background, applicants for temporary work visas must provide the following documentation:

  • An original or copy of the approved Notice of Petition Approval Form I-797
  • The Form I-129 submitted by your prospective employer
  • The Labor Condition Application Form ETA-9035 approved by the U.S. Department of Labor
  • Educational degree certificates
  • Letter of employment offer or contract from the U.S. company, pay stubs, and IRS-certified copies of taxes if work has already begun

While H-1B applicants are not required to demonstrate that they have a residence abroad, they are required to demonstrate that they are qualified for the position they have secured and that the employer is a bona fide institution. Other evidence regarding the validity of the employment could include evidence of prior work experience and evidence of the company or firm’s history, or copies of income tax returns for prior work in the U.S.
